Fluxmans Successful In High Court Judgment - Trevor Simon

On 20 June 2023, the Applicants obtained an ex parte urgent interim order in the High Court of South Africa( Gauteng Division, Johannesburg) against our client for interim relief. Following service of the interim order on our client, Fluxmans brought an application to the High Court for the reconsideration of the Interim Order. Substantive Affidavits were filed by the parties. The Reconsideration Application was heard by Judge Wilson in the High Court on 12 October 2023.

The Judge held that the Applicants’ conduct in the Ex Parte application fell far short of the standards required when bringing such an application. The Interim Order was set aside and replaced with an Order dismissing the application for interim relief. The Applicants were also directed to pay our client’s costs of the Reconsideration Application on the scale as between attorney and client.
